At all times you are in charge of the direction of my representation.

AREAS OF PRACTICE
Wills and Trusts
Simply stated a Last Will and Testament (Will) or a Revocable Trust (commonly known as a Living Trust) is a set of instructions explaining what you want to happen to your property after you die and who you desire to be the guardian(s) for any minor children or developmentally disabled adults.
Durable Power of Attorney
This document allows you to name someone to act on your behalf regarding your business affairs during your life. This power can be granted immediately to the named person or this power can be granted to the named person only if you are unable act for yourself (springing).
Designation of Patient Advocate
It is very important for you to name an individual and alternate to make your medical decisions should you be unable to do so. Only the person you properly appoint can act on your behalf.
Special Needs Trust
If your child or grandchild is receiving or will receive governmental assistance (SSI or Medicaid), a properly drafted Special Needs Trust needs to be part of your estate plan to prevent the beneficiary from having his or her benefits reduced or terminated. I have experience in these matters.
In order to best protect your personal assets, it is extremely important for a Michigan Limited Liability Company (LLC) or Michigan Corporation (corp. or inc.) to be set up to own your business.
For businesses that have more than one owner, who are not married to each other:
- It is important to detail: how the business will be operated; the powers of the members, managers, shareholders, directors, or officers.
- It is also important to prepare buy/sell agreements and determine what happens to the ownership interest of a member or shareholder should that person die, become unable to participate in the business, or want to withdraw from the business.
Probate and Trust Administration
When a person dies owning assets in his or her individual name, those assets need to be probated in order to pass the assets to his or her heirs or devisees.
Medicaid Nursing Home Planning
You should consider contacting me when a nursing home or extended care facility stay is becoming likely for your loved one. This could be when your loved one is in the hospital and will be going to a nursing home or when the health of your loved one is declining such that he or she will eventually need nursing home care.
